Data Protection Notice
This notice sets out the purposes for which we may use personal information in connection with the accounts or services we provide, and the circumstances in which, and to whom, we may disclose personal information.
1 Your personal information
AIB Bank (CI) Limited (the "Bank") is the data controller and controls the personal data and information that you provide, or which we obtain from others in connection with your Account (the “personal information”). Where you are a Company, a partnership, a Trust or an unincorporated association, references in this Data Protection Notice to ‘‘you’’ or ‘‘your’’ shall be construed as references to the Company, partnership, Trust or unincorporated association, or where relevant, to parties connected to the Account Holder such as the directors, secretary, signatories, shareholders and/or beneficial owners or controllers, partners, trustees, settlors, beneficiaries or officers as applicable and any other individual whose personal details you disclose to us.
2 Your consent to the use of your information
2.1 By signing the Account Application Form and Mandate you consent to the Bank, its agents and service providers processing the personal information for the purposes set out in this Data Protection Notice.
2.2 When you give us information about any individual, you confirm that they have appointed you to act for them, to consent to the processing of their information and to the transfer of their information abroad and to receive any data protection notices on their behalf.
2.3 You consent to the Bank transferring the personal information between its offices in Jersey and the Isle of Man for the purposes of administering your Account and for all other purposes set out in this Data Protection Notice and you consent to either the Jersey office or the Isle of Man branch of the Bank maintaining, managing or operating your Account, notwithstanding the home jurisdiction of your Account.
2.4 You also consent to the Bank transferring your information to countries outside the European Economic Area, Jersey or the Isle of Man, which may not necessarily provide an equivalent level of data protection. If we do make such a transfer, we will put in place a contract to ensure that the personal information is adequately protected.
3 Purposes for which your information is used
3.1 The personal information, including information on your Account and its transactions and, where appropriate, card transactions and what we know from our relationship with you and operating your Account, may be used for administration, customer services, marketing, research, product and system development and testing, analysis, credit-scoring, risk assessment, customer profiling, internal monitoring, auditing, debt recovery, and for the detection and prevention of crime including fraud, money laundering and terrorism.
3.2 To check your identity and to prevent or detect crime we may search (as appropriate) the files of address validation directories, the electoral register, internet databases (and similar) and may contact your referees, bankers or persons certifying or providing relevant documentation or information, to confirm details given to us and may make such other enquiries of relevant third parties e.g. of another financial institution or party providing funds as we deem necessary either in connection with your application or at any other time in connection with the operation of your Account.
3.3 To help us make credit decisions about you and to prevent or detect crime, we may search the files of credit reference agencies who could record such searches against you on your file. We may also disclose details of how you conduct your Account to such agencies. The information may be used by other credit grantors for making credit decisions about you and the people with whom you are financially associated. On request we will tell you the names of the agencies we have used so you may obtain a copy of the details they may hold about you.
3.4 We may monitor and record calls made or received by us to check your instructions, to maintain or improve our service, for staff training purposes and for your and the Bank’s protection (for example as a record in the case of a dispute) and for the prevention or detection of crime.
3.5 We may keep your information for a reasonable period for any of the purposes stated in this Data Protection Notice.
4 Disclosure of your information to others
4.1 We will only disclose your confidential information under the circumstances set out in this Data Protection Notice or as otherwise permitted by law. Your information may be disclosed for the purposes described herein to companies within the AIB Group and to our and their respective agents and service providers operating under confidentiality agreements, including, without limitation, other banks, Visa and the Issuer of the Card. To carry out payment transfer instructions we will disclose information about the payer (such as the payer’s name, address and account number) and the payee’s details to our agents including BACS, the Society for Worldwide Interbank Financial Telecommunication (SWIFT), correspondent banks (as applicable) and the beneficiary’s bank.
4.2 Each of these persons may also process information about your Account, including personal information, for the purposes of complying with applicable laws, including without limitation anti-money laundering and anti-terrorism laws and regulations, and may disclose it to any regulatory or governmental authority or to other persons whether in Jersey, the Isle of Man or elsewhere in connection with such purposes.
4.3 In addition, we may disclose your information to appropriate regulatory or governmental authorities (whether in Jersey, the Isle of Man or elsewhere) as required, and to auditors, insurers, ombudsmen and legal advisers; to anyone having a legal right to the information; to anyone where the Bank has the right or duty to disclose by law; to any person to whom we may transfer or assign rights or obligations under the Agreement between you and the Bank; to law enforcement authorities for the purposes of the investigation or prevention of crime; to anyone whom you appoint to administer or operate your Account; and to anyone to whom you instruct the Bank to disclose your information.
5 Promotion of products and services
The Bank may occasionally advise you by post, telephone or electronically of products or services available either from the Bank or companies within the AIB Group or from carefully selected third party providers which may be of interest to you, unless you notify us at the relevant address given below that you do not wish to receive such information. We will not disclose your information outside the AIB Group for marketing purposes.
6 Your rights of access to your personal information
Under applicable data protection legislation, any individual in respect of whom we hold/process personal information has a right to obtain a copy of their information (for which we charge a small fee as permitted by statute, currently GBP 10.00).
